How we comply with privacy obligations?

This Privacy Statement sets out the policy of Anytime and its franchisees with respect to the way in which we obtain, use and disclose information about you, including through our website at stage.anytimefitness.ph. This Privacy Policy explains Anytime Fitness’s approach to the handling of personal information, and how we comply with our privacy obligations.

If you provide us with information about your health, we also strive to ensure that our handling of that information complies with applicable State and Territory health records legislation.

What Personal or Sensitive Information do we collect from you?

For the purposes of this Statement, “Personal Information” is information from which your identity is apparent or can be reasonably ascertained. “Sensitive Information” is information about your health.

The types of Personal Information generally collected by us include your name, address, mobile and telephone numbers and e-mail address, credit card or bank account details, occupation and your employer, and your date of birth. Personal Information is also collected when you provide business cards or other documentation to us containing such Personal Information, including when you complete a Membership Agreement and a Health Questionnaire. Personal Information also includes information we collect in the course of providing services to you and communications between you and us.

The types of Sensitive Information generally collected by us include information relating to your health and health related information that is necessary to properly advise you about fitness training.

Does Anytime Fitness share my personal information with anyone else?

Anytime Fitness will disclose your personal information in a few different ways.

Like most businesses, sometimes we outsource or “contract out” specific support services from time to time, and this may mean that our contractors see your personal information. For instance, sometimes we may engage IT contractors to maintain our databases. All our contractors are subject to strict confidentiality obligations, which means that they are authorised only to use personal information in order to provide the services or to perform the functions required by us.

We will disclose personal information if we are under a legal requirement to do so (e.g., under a court order, or if required under legislation), or if an authorised request is made from a law enforcement agency.

Otherwise, we will only disclose personal information with the consent of the relevant individuals. For example, if you are a member, with your consent (and only with your consent):

* We may provide personal information to Anytime Fitness ‘s personal trainers to assist you to improve your fitness and well being, and so they can advise you which fitness programs are suitable for you. If personal trainers are contractors (rather employees), their contracts with us require them to keep your personal information confidential. Of course, all our employees are required to keep your personal information confidential also; and
* We may disclose personal information to our business partners so that they can contact you directly with special offers, discounts or other membership benefits.

Website/online privacy

As we also collect personal information through stage.anytimefitness.ph (our website), this Privacy Policy also outlines our approach to online privacy issues. In that context, it is to be read as forming part of the terms of use for our website.

Generally, Anytime Fitness will handle personal information collected online consistently with the way that it handles personal information collected offline. Other matters specific to our handling of personal information online are set out below.

**a) Cookies**
When you visit our website, we will not collect any personal information unless you chose to provide it to us (e.g., by sending us e-mails through our website). However, we may collect certain data that does not identify you (sometimes called “web log information”) when you visit certain pages, such as the type of browser and operating system you have. We may also use “cookies,” which are small files that are stored on your computer and that manage the security and navigation process of the site. You can choose to block these cookies but some portions of the site may not function correctly if you do. This type of data is collected for statistical purposes only, and while cookies will identify your computer, they are unlikely to identify you personally.

**b) E-mail/SMS marketing**
We will not e-mail or SMS you marketing material unless you have consented to this. Further, you can unsubscribe from our e-newsletter or other bulletins by using the “unsubscribe” facility contained in each electronic publication we send.

**c) Site security policy**
Our website uses up-to-date technology to maximize the security of your personal information.

What to do if you don't want our mail-outs?

In each e-mail or each piece of marketing material that you receive from us, we will endeavor to attach simple instructions on how you can immediately unsubscribe from our mailing list. In any event, you can opt out from receiving promotional material by e-mailing the relevant Privacy Officer and asking to be removed from the mailing list. Alternatively, you can fax or mail a request asking for deletion. Our contact details are set out below. There is no fee due to us for any such deletion.

Security

We use all reasonable endeavours to secure any Personal or Sensitive Information that we hold about you and to keep this information accurate and up-to-date. Your Personal and Sensitive Information is stored behind industry standard firewalls and where applicable, protected by user names and passwords. Where appropriate, your Personal and Sensitive Information is kept within a locked storage room.

From time to time we may decide to amend or update this Statement. When this occurs, we will post any changes on the website. We encourage you to periodically review this Statement so that you remain informed as to how we are protecting your Personal and Sensitive Information.

Access and correction of your personal information

You can ask to obtain access to your personal information that we and/or our contractors hold, although under some circumstances permitted by law, we may not provide such information to you. Also, we may not be able to require our contractors to provide personal information to you.

We may ask you to put your request in writing. It is important to us that the personal information we hold about you is accurate, complete and up to date.
